USER AGREEMENT

The music created by Wonderspin artists may be used in independent and/or student films intended for film festivals and noncommercial use. We request that the film maker contact us in the event their film gains distribution. In other words, if you're making money, we'd like our musicians/artists to benefit from this. However, we WANT our music in your film and do not expect to get rich doing this. Please know that should your film gain distribution it is not our desire to cause you to have to edit your film and remove our music. We simply want to be notified and given an opportunity to be paid a fair (industry standard) amount. That amount would never exceed $500.00 and in many cases would be much less. Furthermore, we would never want payment in advance, in other words, you'd only pay if you get paid. That said, for legal purposes, we must state the following: If at any time any film gains distribution, the film maker's right to use any Wonderspin song is immediately revoked and the film maker must contact Wonderspin to re-negotiate any such use (at that time a small fee {comparable to the industry standard} MAY be required. In addition, the following guidelines and requirement must be followed and met:

1. The film maker/producer must notify Wonderspin of intended use via e-mail.
2. The film maker/producer must acquire/purchase the Wonderspin CD containing the desired song OR purchase the MP3 (if available).
3. The film maker must complete a Film Application and provide the completed form to Wonderspin.
4. The film to feature the Wonderspin song should not contain:
A) Pornographic footage and or material.
B) Content which supports/encourages racist behavior and/or ideas (i.e. white power/etc...)
C) Content which supports/encourages sexiest behavior or ideas (i.e. sexual harassment/spousal abuse, etc...)
D) Content which supports/encourages discrimination based on race, color, national origin, sex, age, disability, or religious opinion and/or belief.
E) Any material which would be viewed as offensive by the majority of the US population.
5. The song used must be credited to Wonderspin and the performing artist in the following manner:
A) The film's end credits must include the name of the song and artist, giving credit to the artist.
B) The song and artist's name must be legible and must appear on screen long enough to be read.
E) The song and artist's names must appear with "wonderspin.com" in the same font size for the same duration.
Example: "Black Lung" performed by 1971 available at wonderspin.com
6. Wonderspin retains the right to refuse the use of any song at any time for any reason.
7. All of the above guidelines must be met, and the Film Application must be completed and on file with Wonderspin.com prior to any song being used in any film.
